Pursuant to Article 13 of the "European Regulation 2016/679 on the protection of individuals with regard to the processing of Personal Data and on the free movement of such data" (hereinafter "GDPR"), Bologna Football Club 1909 S.p.A. (hereinafter "Bologna FC" or the "Data Controller") with registered office in Via Casteldebole 10 - 41132 - Bologna -, in its capacity as Data Controller, is required to provide users who make use of the services made available (website https://www.bolognafc.it/, https://www.bolognafc.vivaticket.it, "Sites", "Bologna FC" "App" application, cashiers, ticket offices, points of sale and any other collection point of Bologna FC) with certain information regarding the processing of personal data. This document constitutes the "Privacy Policy" of Bologna FC (subject to any appropriate future updates).
This Privacy policy is drafted in the Italian language and translated into English. In the event of any conflict or uncertainty or doubt as to interpretation, the meaning of the Italian version shall prevail.
I. - Warnings and Protection of Minors.
The processing of your personal data will apply the principles of lawfulness, correctness and transparency. Personal data will be collected for specified, explicit, legitimate purposes (purpose limitation) and will be adequate, relevant and limited in relation to the purposes for which they are processed (data minimisation). They will always be kept up-to-date and accurate and stored for a period of time not exceeding what is necessary for the purpose of executing the contract, without prejudice to the fulfilment of legal and fiscal obligations that establish longer retention periods (retention limitation). Personal data shall be processed by adopting all appropriate security measures to guarantee its integrity, confidentiality and unavailability to unauthorised third parties (integrity and confidentiality). If not expressly indicated, the provision of personal data through the collection points on the Sites or in the App is reserved for those over 14 years of age, except for the purchase of products and services, which is reserved for those over 18 years of age.
II. - Reference standards, purposes, legal bases and retention periods.
The processing operations, which we will explain to you in detail below, have their legal basis in the rules governing your right to the protection of your personal data, your right to confidentiality, and those that allow you to express or revoke, at any time, your informed consent to the processing operations, namely: EU General Regulation 679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the Privacy Code (Legislative Decree 196/2003).
Bologna FC will use your personal data, collected through your interactions with Bologna FC's logical and physical domains, for the purposes that are described in detail below, together with the legal basis for processing and the data retention periods.
a) - Browsing - to allow the use of Bologna FC's technological resources (Internet sites and apps) and the enjoyment of their contents, as well as to ascertain any computer crimes.
The legal basis for the processing is represented by the need to execute a contract to which you, as a data subject, are a party or to carry out a request of yours (Art. 6(1)(b) GDPR) as well as, with regard to the purposes of investigating possible criminal offences, by the legitimate interest of the Data Controller (Art. 6(1)(f) GDPR).
Except as provided for in the cookie policy, data is deleted within seven days and retained for a longer period only in the case of defensive needs.
b) - Registration to restricted areas - Allow registration and access to restricted areas of the Sites or App.
The legal basis for the processing is the need to execute a contract to which you, as a data subject, are party or to fulfil a request of yours (Art. 6(1)(b) GDPR).
Data is kept as long as the account is active, unless kept for a longer period for defensive purposes.
c) - Tickets, Season Tickets and Accreditation - Manage and execute the fulfilments related to the purchase of tickets and/or season tickets and the related legal obligations (VRO - Verification of the obstructive requirements, pursuant to the Ministerial Decree of 15 August 2009), including the identification of the purchaser and the users of the purchased tickets, as well as the issuing of accreditation to persons authorised to access the stadium for office or service reasons.
The legal basis for the processing is represented by the need to execute a contract to which you, as a data subject, are a party or to carry out a request made by you (Art. 6(1)(b) GDPR) and the need to fulfil legal obligations to which the Controller is subject (Art. 6(1)(c) GDPR).
In the event of the processing of data belonging to special categories pursuant to Art. 9 of the GDPR, such as data relating to the state of health, provided, for example, for access and/or transport to stadium areas and/or benefits reserved for persons with disabilities, consent to the processing will be required, which therefore constitutes the legal basis pursuant to Art. 9(2)(a) of the GDPR. The transport services for the disabled are carried out in collaboration with PMG Italia S.p.a. co-owner of the relevant processing.
For purposes related to the issuance of tickets, data are kept for seven days from the date of the football event to which they refer (Ministerial Decree 6.06.2005) except for security and judicial needs. Furthermore, the data is kept for 5 years from the termination of the contract for administrative, accounting and legal defence purposes. Data relating to health conditions will be kept for the time strictly necessary to benefit from the facilitation.
d) - We Are One Card (Fidelity Card) - Manage and execute, including the identification of the purchaser, the fulfilments, including legal ones, relating to the purchase, issuance, activation of the We Are One Card, as well as related services and benefits. It should be noted that the We Are One Card is equipped with RFID technology with a microchip that allows the card to be read near the turnstiles located at the entrances to the stadium, at a distance of up to 6 centimetres. The turnstiles do not store any personal data.
The legal basis for the processing is represented by the need to execute a contract to which you, as a data subject, are a party or to carry out a request made by you (Art. 6(1)(b) GDPR) and the need to fulfil legal obligations to which the Controller is subject (Art. 6(1)(c) GDPR).
The data provided are kept for 5 years beyond the expiry date of the card for administrative, accounting and legal defence purposes.
e) - Code of Conduct - In relation to the purchase of tickets, season tickets, accreditations and We Are one cards, ascertain the relevant conduct and apply the corresponding sanctions in accordance with the Stadium Regulations and the Code of Regulations for the sale of admission tickets to football events (Code of Conduct), accepted by the purchaser/user of the tickets pursuant to the contract with Bologna FC at the time of purchase. The conduct and the identity of the perpetrators could also be ascertained by means of the video surveillance system, reports of the stewards on duty, the members of the SLO office and the Security Delegate and/or his deputy, the reports of the Judicial Police\Digos, the images disseminated through social networks, in the event that the identity of the person deemed responsible for the relevant conduct can be ascertained, all open sources, in the event of publicly ascertained facts.
The legal basis of the processing is represented and by the need to fulfil legal and regulatory obligations to which the Data Controller is subject (art. 6, par.1, letter c. GDPR), including the provisions of the FIGC (art. 27 of the Code of Sports Justice, FIGC circular of 8 May 2018, prot. no. 21316/SS 17-18), by the need to execute a contract to which you, as a data subject, are a party (art. 6, par. 1, letter b. GDPR), by the legitimate interest of the Controller (art. 6, par. 1, letter f. GDPR).
The data shall be kept for 5 years from the conclusion of the relevant proceedings. It should be noted that the images taken from the video surveillance system, for the above-mentioned purposes, will be kept by Bologna FC for forty-eight hours, unless a different period of time is needed to comply with the procedures established by the Code of Conduct.
f) - Services - To allow the provision of Services requested by you from time to time such as, by way of example: purchase of products, memberships, enrolment in football schools and campuses, participation in events, participation in sports selections, CSR (corporate social responsibility) initiatives carried out directly or in collaboration with our partners, as well as, in general, the performance of activities related to the execution of a contractual relationship with Bologna FC, including any assistance requested by you and the fulfilment of legal obligations, including tax obligations, and including the exercise of your privacy rights.
The legal basis for the processing is represented by the need to execute a contract to which you, as a data subject, are a party or to carry out a request made by you (Art. 6(1)(b) GDPR) and the need to fulfil legal obligations to which the Controller is subject (Art. 6(1)(c) GDPR).
Data are retained for 10 years after termination in the case of a contractual relationship. In other cases they will be retained until the purpose pursued is achieved, and no longer than 5 years after collection.
g) - Defence in court - Defending or asserting, when necessary, the rights of the Company in court.
The legal basis for the processing is represented and the legitimate interest of the Controller (Art. 6(1)(f) GDPR and Art. 9(2)(f) GDPR).
h) - Use of Images - Without prejudice to the right to chronicle, disseminate your image by means of the content and/or experiences that you wish to share, or with prior authorisation to use the image (e.g. during participation in events), through the communication channels of the Owner. Your image portrayed during sporting events may be processed for historical archiving purposes by the Controller.
The legal basis for the processing is your consent (Art. 6(1)(a) GDPR).
Data are retained until consent is revoked.
h.1) - Video-surveillance - to process the images collected by the video-surveillance system at sporting events taking place at the Dall'ara Stadium for the purposes of protecting public safety, preventing, investigating or repressing offences pursuant to the Decree of the Ministry of the Interior of 06.06.2005 laying down the procedures for the installation of video-surveillance systems in sports facilities with a capacity of more than ten thousand, during sporting competitions involving football.
The legal basis is represented by the fulfilment of a legal obligation to which the Controller is subject (Art.6., paragraph 1 lett. c. GDPR).
The images are deleted after 7 days from the football event to which they refer, except when necessary in relation to specific needs to preserve the images for the protection of the rights of the Data Controller, including in court, or if a specific investigative request by the judicial, police, or sports authorities must be complied with,
i) - Soft Spam - Sending you commercial communications by e-mail regarding products and services similar to those you have purchased, unless you expressly refuse to receive such communications, which you may do at the time of purchase or subsequently.
The legal basis for these purposes is Art. 130, para. 4 of Legislative Decree 196/2003 and the legitimate interest of the Data Controller (Art. 6(1)(f) GDPR).
The data are stored until you object to their use for that purpose (opt out), i.e. for up to 24 months after your last purchase.
l) - Marketing - Subject to your consent, carry out marketing activities, including the processing of statistics and/or market research, send you our newsletter or other information and promotional material relating to the activities, products and services of Bologna F.C. and its partners, send you communications and surveys to improve the service ("Customer satisfaction") or to collect your opinions. Such communications may be carried out by means of automatic systems, e-mail, sms, paper mail and/or use of the telephone with operator, web and push notifications; the Data Controller collects a single consent for the marketing purposes described herein, pursuant to the General Provision of the Guarantor for the Protection of Personal Data " Guidelines on promotional activities and the fight against spam " of 4 July 2013. Should you wish to object to the processing for the marketing purposes indicated, you may do so at any time through the functions available on the technology used or by communicating this to the email address indicated in the section on exercising your rights. Any revocation will not affect the lawfulness of the processing based on the consent given before the revocation.
The legal basis for the processing is your consent (Art. 6(1)(f) GDPR).
Data are stored until consent is revoked or deleted 24 months after the last recorded interaction.
m) - Sending personalised communications based on profiling - Subject to your consent, to analyse your interests, habits, consumption choices, and preferences in relation to the products and services offered, with the aid of electronic tools capable of processing by aggregation and comparison your personal data in order to make the communications addressed to you relating to products and services provided by the Data Controller more consistent with your interests and choices. The aforementioned analysis will take into consideration both your purchasing behaviour (date, object and amount of the transactions you have made on the Website or App or at points of sale in the territory and online, including the purchase of tickets, subscriptions and fidelity cards), and your behaviour in consulting the commercial communications sent to you by e-mail, and your browsing behaviour, i.e. information on how you use the App and/or the Website as a registered user, including your similarity in consumption behaviour with other users. More specifically, 'clusters' (homogeneous groups made up of profiles with a certain level of correlation) will be created with the users' data, depending on the user's preferences, online behaviour and purchases made, including through physical points of sale, in order to develop targeted, personalised digital communications in line with the users' tastes. Should you wish to object to the processing for the profiling purposes indicated, you may do so at any time through the functions available on the technology used or by communicating this to the email address indicated in the section on exercising your rights. Any revocation will not affect the lawfulness of the processing based on the consent given before the revocation.
Data are stored until consent is revoked or deleted 12 months after the last recorded interaction.
The legal basis for the processing is your consent (Art. 6(1)(f) GDPR).
In relation to the purposes set out in letters l) and m), limited to the data collected through the website www.bolognafcstore.com, Bologna FC and EPI s.r.l. act as Joint Data Controllers pursuant to Article 26 of the GDPR.
Summary information, supplementary to this one, dedicated to the specific service offered or made available through the app, the website, or third-party applications, may be issued at the time the data are provided.
III. - Nature of the data being processed
The optional, explicit and voluntary sending of electronic mail to the addresses indicated on the Bologna FC websites entails the subsequent acquisition of the sender's address, which is necessary to reply to requests, as well as any other personal data included in the message.
The following categories of personal data concerning you will or may be processed for the purposes indicated.
a). - Common personal data.
In the event of registration on the Sites or use of the services available: first and last name, date and place of birth, tax code, residential address, family status, e-mail address, username, password and telephone number, data relating to purchase preferences, online behaviour, data relating to tickets purchased, seat, row sector and event.
Your identity document may also be required for the use of particular services. Furthermore, an image of you may also be processed.
(b) - Technical treatments.
Also subject to processing are the IP number, one or more identifiers of your mobile device, and the type of browser used by you to connect to it (non-directly identifiable data), the use of the APP also for receiving push notifications, automatically recorded by logical protection and access control devices (LOG FILES) and in the event of activation of specific services. This personal data will be used not only to ensure the availability of the service, but also to control network traffic. This information is not collected in order to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This data is used for the purpose of allowing user authentication, if any, and to obtain statistical, anonymous information on the use of the Sites, the services and the APP and to check their correct functioning and are deleted immediately after processing, unless their storage is indispensable for the reasons indicated above. The computer systems and software procedures used to operate the APP (such as Apple Store and Google Play) acquire, in the course of their normal operation, certain data relating to the User whose transmission is implicit in the use of internet communication protocols, smartphones and devices used. The User may consult the information on Privacy available on the following sites:

The data could also be used to ascertain liability in the event of hypothetical computer crimes.
c) - Cookies
The Site uses session (non-persistent) technical cookies, strictly limited to what is necessary for safe and efficient navigation on the Site.
The Site uses analytical cookies for statistical purposes with configurations that exclude the processing of identifying data. The Site uses profiling cookies.

d) - Special categories of personal data.
In the event that Bologna FC collects special categories of personal data, pursuant to art. 9 EU Reg. 679/2016 (data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data intended to uniquely identify a natural person, data relating to health or sex life or sexual orientation), you will be informed in advance and put in a position to express - in the manner provided for by law - the relevant consent.
IV. - Nature of conferment, data sources.
IV.1.- The provision of your personal data is not compulsory as a rule, but in some cases it is indispensable to enable you to benefit from all available services.
For the purposes set out in Section II of this notice, the provision of data is necessary in the following cases:
letter a) Browsing: failure to do so may make it impossible to browse the Sites and use the App;
letter b) Registration: failure to provide this information may make it impossible to use the services for which registration is required;
letters c) and d) Tickets, Season Tickets and We Are One Card: failure to do so may result in Bologna FC being unable to issue tickets for admission to the stadium and to issue the We Are One Card;
letter e) Code of Conduct and f) Services: failure to do so may make it impossible to provide the services;
letter h.1) Video surveillance: the provision is mandatory, failure to provide it prevents access to the event.
For the purposes set out in Section II of this notice, the provision of data is optional in the following cases:
letter h) Use of Images: failure to authorise the use of images does not affect the right to participate in the event or otherwise to benefit from the services;
(i) Soft Spam, (l) Marketing, (m) Profiling and (n) Transfer to third parties: failure to provide the information does not imply any consequence, except that you will not be able to receive commercial communications regarding offers, discounts and initiatives, if applicable also personalised according to your needs and preferences, from Bologna FC. and/or third party companies.
IV.2. - Data Sources.
We will collect your data, either directly from you, through your interactions with the Websites and with the APP and in general with Bologna FC services (such as browsing, subscribing to the online shop, subscribing to newsletters, filling in forms, subscribing to the Web Push channels of the Websites, purchasing tickets, subscriptions and fidelity cards both online and at points of sale), or through the information received from authorised third parties, authorities, public sources, third party service providers, if any appointed as external data processors.
V. - Method of processing your personal data.
In relation to all the above-mentioned purposes, your personal data will be subject to computer and paper processing and processed by special computer procedures also for the purpose of customising the services that Bologna FC is able to offer you. Your data will be processed in such a way as to guarantee its logical and physical security and confidentiality, and may be processed by means of manual, computerised and telematic tools suitable for storing, transmitting and sharing your data. The logic of the processing will be strictly related to the purposes pursued. With particular regard to the purpose of profiling, please refer to what is described in detail in paragraph II letter m).
VI. - Data recipients and transfers abroad.
VI.1. - Persons responsible for and authorised to process data.
The following may become aware of the personal data, as referred to in this information notice, in their capacity as Data Processors or Persons in charge of the processing: within Bologna FC, qualified personnel, each within the limits of his or her competences and duties and on the basis of the tasks assigned and the instructions given. Outside Bologna FC, third parties, also specifically designated as Data Processors or Persons in charge of the processing - of which Bologna FC makes use such as consultants, also in associated form, companies offering IT services, companies offering marketing and call centre services, other service companies, as well as other entities in compliance with any legal obligations.
VI.2. - Transfer of personal data abroad.
Your personal data will be stored within the European Union. In case of transfer also through third parties, service providers, the relevant operations will take place exclusively within the scope of and in compliance with EU Reg. 679/2016 Art. 44 ff.
VI.3. - Dissemination (to unspecified external parties) of data.
Under no circumstances may personal data be disseminated, except as
provided for in Section II, letter h).
VII. - Rights of the data subject.
Articles 15 to 22, GDPR grant data subjects the exercise of specific rights. The GDPR grants data subjects the right to access and obtain a copy of their personal data. The right to obtain a copy of data must not infringe the rights and freedoms of others. By requesting access, the data subject has the right to obtain confirmation from Bologna FC as to whether or not their personal data is being processed and to know the purposes and categories of data processed, the third parties to whom the data is disclosed and whether the data is transferred to a non-EU country with adequate safeguards. The data subject also has the right to know the storage time of his or her personal data and the right to request the rectification of inaccurate data and the integration of incomplete data, the deletion (right to be forgotten), the restriction of processing, the revocation of consent, the portability of data and the right to object, at any time and without having to provide justification, to processing for direct marketing purposes. A data subject who considers that the processing of his or her personal data violates the provisions of the GDPR or internal data protection regulations has the right to lodge a complaint with the Italian Data Protection Authority based in Rome, Piazza Venezia, 11, pursuant to Art. 77 GDPR and/or to take legal action.

This document defines the conditions of use, by the User, of the Website that can be reached at the web address www.bolognafc. owned by Bologna Football Club 1909 S.p.a. (BFC), with registered office in Via Casteldebole 10, 40132, Bologna, VAT and tax code 02260700378, Bologna REA number 268824.
1. Use, responsibilities and prohibitions.
1.1 By using the Site and/or simply browsing it, the User accepts these Terms of Use.
1.2 The use of the Site is limited to the possibility for the User to visit and view the pages of the Site for personal use; the User is also allowed to register on the Site in order to obtain access to services related to the purchase of Tickets or Access Tickets available on the Site, or in order to take advantage of any further functionalities or services.
1.3 Any use of the Site for purposes other than those expressly indicated in these Terms and/or published on the Site itself is prohibited. By way of example but not limited to the following is prohibited:
(a) use the Site or parts thereof for illegal purposes;
(b) distributing, transmitting, modifying or tampering with the Site and the materials contained therein in any manner whatsoever, for any purpose whatsoever (e.g. for advertising, commercial purposes, requesting third parties, even if they are users of the Site);
(c) downloading or transmitting directly or indirectly via the Site: viruses, macros, trojans, or any other element designed to interrupt or damage or interfere with the normal operation of a computer, or material of a defamatory, offensive or obscene or threatening nature or material that may cause distress, harassment or other negative consequences;
(d) use the Site in such a way as to: interrupt its operation, damage the Site, deteriorate its rendering or impair its operation or functionality, or infringe or damage the rights of any person, company or corporation (including without limitation intellectual property rights, confidentiality or privacy rights); more specifically, any use and/or reproduction, even partial, of the Site or its contents, or publications on the Site (e.g. articles, images, stories, software or other material subject to copyright) that infringe BFC's and/or third parties' industrial property rights and/or copyright and/or other third parties' rights (such as image rights or rights relating to personal data) is prohibited;
(e) create or publish a hyperlink to any part of the Site or access or attempt to access without authorisation any part or component of the Site;
(f) use and/or reproduce, even partially, the Site or its contents for the purpose of commercial activities and/or sales;
(g) use any automatic or manual means to monitor or copy the Site or individual pages of the Site or any part of the Site and/or its contents;
(h) use automated means to submit or place orders for the purchase of tickets.
1.4 Violation of these prescriptions implies the civil and criminal liability of the User and will be prosecuted. In the event of violations, BFC may also take any further protective action such as, by way of example: denying the User access to the Site, removing unauthorised content, cancelling purchase orders.
2 Site Registration.
2.1 Browsing the Site is free, but registration and the creation of a personal account is required to use certain services.
2.2 Registration is only permitted to Users who have reached the age of majority. At the time of Registration, the User must provide his/her personal data and accept the Conditions of Use of the Site or the General Conditions in case of purchase of Tickets or Access Tickets. The User is directly liable for the veracity of the data entered, expressly releasing BFC from any liability in this respect. In the event that, in order to issue Tickets or Access Tickets, it is necessary to enter the data of third parties, the User is directly responsible for the accuracy of such data.
2.3 To register on the Site, the User must:
(a) enter the required personal data, choose a secure password and complete the registration process according to the required security procedures.
2.4 The registration password is personal and confidential and must not be disclosed to third parties. The User is directly liable in the event of violation of the rules on the conservation of credentials. It is prohibited to create several accounts on the Site referring to the same person and/or different legal entity (company and/or entity of any kind).
3. Registration via third-party authentication services.
3.1 Registration by means of third-party authentication systems implies the possibility of receiving certain personal information about the User from the third party. In any case, registration by such means is subject to the same requirements as direct registration.
4. Limitation of liability of BFC.
4.1 The information, software and services that may be available through the Site may contain inaccuracies, notwithstanding the adoption of due care by BFC. The latter makes no express or implied representations or warranties as to the operation of the Site or its reliability. BFC shall in no event be liable for any direct or indirect, special or consequential damages, expenses, loss of profits or any other damages suffered by you in connection with the use of the Site. Downloading and/or sharing of any material is done at the sole risk and responsibility of the User. BFC is not responsible for the content of any website that may be accessed via links on the Site. The possible presence of said links on the Site does not imply any guarantee as to the reliability of the third party sites. The User is solely responsible for the correct and continuous functioning of the connectivity, devices and methods with which he/she uses the Site. BFC will therefore not be liable for any damage, of whatever nature, arising from the use of the Site and/or its contents and/or ticket sales services. The User will not be entitled to any compensation in the event of failure to use the Site or parts thereof as a result of breakdown, suspension or inaccessibility of the Site or parts thereof for any reason whatsoever. Any liability of BFC for acts, omissions and conduct by Users of the Site and/or third parties such as, by way of example, advertisers and/or sponsors and/or commercial partners is also excluded.
5. Changes and control of the Site.
5.1 BFC reserves the right to amend these Conditions of Use of the Site at any time, with immediate effect, or to modify or make inaccessible, or suspend, the Site (or part of it) even without notice to Users and/or monitor any activities and content associated with the use of the Site, by the User, carried out in violation of the Conditions of Use of the Site.
6. Copyright and Industrial Property.
6.1 All content published on the Site is provided by BFC or by third parties. You acknowledge and agree that all data, information, photographs, videos, images, audio, software, music, illustrations, graphics, icons, interfaces, logical resources, features, texts and any other material on the Website are the property of BFC or third parties and are protected by national and international copyright and industrial property law. The trademark Bologna Football Club (BFC 1909) is registered and owned by Bologna Football Club 1909 s.p.a. Any use of the name and/or trademark of BFC by the User is excluded. It is in no way permitted to duplicate, copy, download, modify or distribute the Website or its contents, including all industrial and intellectual property rights (trademarks, copyright, etc.).
6.2 Downloading and copying of material published on the Site is permitted for personal use only. Any further use is expressly excluded.
6.3 Any violation will be duly prosecuted.
7. User's obligation to indemnify.
7.1 The User undertakes to indemnify and hold BFC harmless from any liability, loss, damage, claim, pecuniary or other penalty, cost and charge, including, without limitation, legal fees, in relation to failure to comply with the provisions of these Terms of Use of the Site.
8. No waiver and jurisdiction
8.1 The circumstance that BFC does not exercise a right or does not enforce a provision of these Terms of Use of the Site does not in any case constitute a waiver of such right or provision. Any dispute relating to the Use of the Site shall fall under the jurisdiction of the Court of Bologna.
9 Protection of personal data when using the Site.
9.1 The User's personal data, collected for the purpose of using the Site and the Services available therein, are processed in compliance with EU Reg. 679/2016 (GDPR) according to the Privacy Policy and Cookie Policy, which can be consulted on the Site.
Ai sensi dell’articolo 13 del “Regolamento Europeo 2016/679 relativo alla protezione delle persone fisiche con riguardo al Trattamento dei Dati Personali, nonché alla libera circolazione di tali dati” (da ora in poi “GDPR”), Bologna Football Club 1909 S.p.A. (di seguito “Bologna FC” o “Titolare”) con sede legale in Via Casteldebole 10 – 41132 – Bologna –, in qualità di Titolare del trattamento, è tenuta a fornire agli utenti che fruiscono dei servizi resi disponibili (sito internet https://www.bolognafc.it/, https://www.bolognafc.vivaticket.it, ”Siti”, Applicazione “Bologna FC” “App”, casse, biglietterie, punti vendita ed ogni altro punto di raccolta di Bologna FC) alcune informazioni relative al trattamento dei dati personali. Il presente documento costituisce la “Privacy Policy” di Bologna FC (soggetta in futuro ad ogni opportuno aggiornamento).
I. - Avvertenze e Protezione Dei Minori.
Il trattamento dei tuoi dati personali farà applicazione dei principi di liceità, correttezza e trasparenza. I dati personali saranno raccolti per finalità determinate, esplicite, legittime (limitazione delle finalità) e saranno adeguati, pertinenti e limitati rispetto alle finalità per le quali sono trattati (minimizzazione dei dati). Saranno sempre aggiornati ed esatti e conservati per un arco di tempo non superiore a quanto necessario per la finalità di dare esecuzione al contratto, fatto salvo l’adempimento di obblighi di legge e fiscali che fissino tempi più lunghi di conservazione (limitazione della conservazione). I dati personali verranno trattati adottando tutte le misure di sicurezza adeguate a garantirne l’integrità, la riservatezza e la indisponibilità da parte di terzi non autorizzati (integrità e riservatezza). Qualora non espressamente indicato il conferimento dei dati personali attraverso i punti di raccolta presenti sui Siti o sulla App è riservato ai maggiori di 14 anni di età, salvo l’acquisto di prodotti e servizi, riservato ai maggiorenni.
II. - Norme di riferimento, finalità, basi giuridiche e tempi di conservazione.
Le operazioni di trattamento, che di seguito ti illustreremo nel dettaglio, hanno il loro fondamento giuridico nelle norme che disciplinano il tuo diritto alla protezione dei tuoi dati personali, il tuo diritto alla riservatezza, ed infine in quelle che ti permettono di esprimere o di revocare, in qualsiasi momento, il tuo consenso informato alle operazioni di trattamento, vale a dire: il Regolamento Generale UE 679 del 27 Aprile 2016 relativo alla protezione delle persone fisiche con riguardo al trattamento dei dati personali, nonché alla libera circolazione di tali dati ed il Codice Privacy (D. Lgs. 196/2003).
Bologna FC utilizzerà i tuoi dati personali, raccolti mediante le tue interazioni con il dominio logico e fisico di Bologna FC per le finalità che vengono di seguito dettagliatamente descritte unitamente alla base giuridica del trattamento ed ai tempi di conservazione dei dati.
a) - Navigazione - consentire l’utilizzo delle risorse tecnologiche di Bologna FC (siti internet e app) e la fruizione dei relativi contenuti, nonché accertare eventuali reati informatici.
La base giuridica del trattamento è rappresentata dalla necessità di dare esecuzione ad un contratto di cui tu, in qualità di soggetto interessato, sei parte ovvero di dare corso ad una tua richiesta (art. 6, par. 1, lettera b. GDPR) nonché, relativamente alle finalità di accertamento di eventuali reati, dall’interesse legittimo del Titolare (art. 6, par. 1, lettera f. GDPR).
Salvo quanto previsto dall'informativa cookies, i dati vengono cancellati entro sette giorni e conservati per un periodo maggiore solo nel caso di esigenze difensive.
b) - Registrazione ad aree riservate - Consentire la registrazione e l’accesso alle aree riservate dei Siti o dell’App.
La base giuridica del trattamento è rappresentata dalla necessità di dare esecuzione ad un contratto di cui tu, in qualità di soggetto interessato, sei parte ovvero di dare corso ad una tua richiesta (art. 6, par. 1, lettera b. GDPR).
I dati vengono conservati finché l’account è attivo, salvo conservazione per un periodo maggiore per finalità difensive.
c) - Biglietti, Abbonamenti e Accrediti - Gestire ed eseguire gli adempimenti relativi all’acquisto di biglietti e/o abbonamenti e relativi obblighi di legge (VRO - Verifica dei requisiti ostativi, ai sensi del D.M. 15 agosto 2009), ivi compresa l'identificazione dell’acquirente e degli utilizzatori dei titoli acquistati, nonché per il rilascio degli accrediti ai soggetti autorizzati all’accesso allo stadio per motivi di ufficio o di servizio.
La base giuridica del trattamento è rappresentata dalla necessità di dare esecuzione ad un contratto di cui tu, in qualità di soggetto interessato, sei parte ovvero di dare corso ad una tua richiesta (art. 6, par. 1, lettera b. GDPR) e dalla necessità di adempiere agli obblighi legali cui è soggetto il Titolare (art. 6, par.1, lettera c. GDPR).
In caso di trattamento dei dati appartenenti a categorie particolari di cui all’art. 9 del GDPR, quali i dati relativi allo stato di salute, conferiti ad esempio per l’accesso e/o il trasporto verso le aree dello stadio e/o ai vantaggi riservati alle persone con disabilità, verrà richiesto il consenso al trattamento, che pertanto ne costituisce la base giuridica ai sensi dell’art. 9, par. 2, lettera a) del GDPR. I servizi di trasporto dei disabili sono svolti in collaborazione con PMG Italia S.p.a. contitolare del relativo trattamento.
Per le finalità correlate all’emissione dei biglietti, i dati vengono conservati per sette giorni dalla data dell’evento calcistico cui si riferiscono (D.M 6.06.2005) salvo le esigenze di sicurezza e giudiziarie. Inoltre i dati sono conservati per 5 anni dalla cessazione degli effetti del contratto per finalità amministrative, contabili e di difesa in giudizio. I dati relativi alle condizioni di salute verranno conservati per il tempo strettamente necessario a fruire della facilitazione.
d) - We Are One Card (Fidelity Card) - Gestire ed eseguire, ivi compresa l'identificazione dell'acquirente, gli adempimenti anche legali relativi all’acquisto, rilascio, attivazione della We Are One Card, nonché relativi ai servizi e ai vantaggi correlati. Si precisa che la We Are One Card è dotata di tecnologia RFID con funzionamento di un microchip che consente la lettura della tessera in prossimità dei tornelli ubicati agli ingressi dello stadio, ad una distanza variabile fino a 6 centimetri. I tornelli non memorizzano alcun dato personale.
La base giuridica del trattamento è rappresentata dalla necessità di dare esecuzione ad un contratto di cui tu, in qualità di soggetto interessato, sei parte ovvero di dare corso ad una tua richiesta (art. 6, par. 1, lettera b. GDPR) e dalla necessità di adempiere agli obblighi legali cui è soggetto il Titolare (art. 6, par.1, lettera c. GDPR).
I dati conferiti vengono conservati per 5 anni oltre il termine di scadenza della card per finalità amministrative, contabili e di difesa in giudizio.
e) - Codice di Condotta - In relazione all’acquisto di biglietti, abbonamenti, accrediti e We Are one card, accertare le condotte rilevanti ed applicare le corrispondenti sanzioni ai sensi del Regolamento d’uso dello Stadio e del Codice di Regolamentazione della cessione dei titoli di accesso alle manifestazioni calcistiche (Codice di Condotta), accettati dall’acquirente/utilizzatore dei titoli ai sensi del contratto con Bologna FC al momento dell’acquisto. Le condotte e l’identità degli autori potrebbero essere accertate anche mediante il sistema di videosorveglianza, segnalazioni del personale steward in servizio, dei componenti dell’ufficio SLO e del Delegato per la Sicurezza e\o del suo vice, le informative della Polizia Giudiziaria\Digos, le immagini diffuse a mezzo dei social network, nel caso in cui sia possibile accertare l’identità del soggetto ritenuto responsabile della condotta rilevante, tutte le fonti aperte, in caso di fatti pubblicamente accertati.
La base giuridica del trattamento è rappresentata e dalla necessità di adempiere agli obblighi legali e regolamentari cui è soggetto il Titolare (art. 6, par.1, lettera c. GDPR), comprese le disposizioni della FIGC (art. 27 del Codice di Giustizia Sportiva, circolare FIGC 8 maggio 2018, prot. n. 21316/SS 17-18), dalla necessità di dare esecuzione ad un contratto di cui tu, in qualità di soggetto interessato, sei parte (art. 6, par. 1, lettera b. GDPR), dall’interesse legittimo del Titolare (art. 6, par. 1, lettera f. GDPR).
I dati sono conservati per 5 anni dalla conclusione del relativo procedimento. Si precisa che le immagini attinte dal sistema di videosorveglianza, per la finalità di cui sopra saranno conservate a cura di Bologna FC per quarantotto ore, salvo il diverso termine derivante dalla necessità di adempiere alle procedure stabilite dal Codice di Condotta.
f) - Servizi - Consentire l’erogazione dei Servizi da te di volta in volta richiesti quali, a mero titolo esemplificativo: acquisto di prodotti, adesione a membership, iscrizione alla scuola calcio ed ai campus, partecipazione ad eventi, partecipazione a selezioni sportive, iniziative di CSR (corporate social responsibility) svolte direttamente o in collaborazione con i nostri partner, nonché, in generale, svolgimento delle attività connesse all’esecuzione di un rapporto contrattuale con Bologna FC, compresa l’eventuale assistenza da te richiesta e gli adempimenti di legge anche fiscali e compreso l’esercizio dei tuoi diritti in materia di privacy.
La base giuridica del trattamento è rappresentata dalla necessità di dare esecuzione ad un contratto di cui tu, in qualità di soggetto interessato, sei parte ovvero di dare corso ad una tua richiesta (art. 6, par. 1, lettera b. GDPR) e dalla necessità di adempiere agli obblighi legali cui è soggetto il Titolare (art. 6, par.1, lettera c. GDPR).
I dati sono conservati per 10 anni dalla cessazione in caso di rapporto contrattuale. Negli altri casi verranno conservati fino al raggiungimento delle finalità perseguite, e non oltre 5 anni dalla raccolta.
g) - Difesa in giudizio - Difendere o far valere, in caso di necessità, i diritti della Società in sede giudiziaria.
La base giuridica del trattamento è rappresentata e dall’interesse legittimo del Titolare (art. 6, par. 1, lettera f. GDPR e art. 9 par. 2, lettera f. GDPR).
h) - Utilizzo Immagini - Salvo il diritto di cronaca, diffondere la tua immagine mediante i contenuti e/o le esperienze che vuoi condividere ovvero previa autorizzazione all’utilizzo dell’immagine (ad esempio nel corso della partecipazione ad eventi), tramite i canali di comunicazione del Titolare. La tua immagine ritratta nel corso degli eventi sportivi potrà essere oggetto di trattamento per finalità di archiviazione storica del Titolare.
La base giuridica del trattamento è rappresentata dal tuo consenso (art. 6, par. 1, lettera a. GDPR).
I dati sono conservati fino alla revoca del consenso.
h.1) - Videosorveglianza - trattare le immagini raccolte dal sistema di videosorveglianza in occasione degli eventi sportivi che hanno luogo presso Stadio Dall’ara per finalità di tutela della sicurezza pubblica, di prevenzione, accertamento o repressione dei reati ai sensi del Decreto del Ministero dell’Interno 06.06.2005 recante modalità per l'installazione di sistemi di videosorveglianza negli impianti sportivi di capienza superiore alle diecimila unità, in occasione di competizioni sportive riguardanti il gioco del calcio.
La base giuridica è rappresentata dall’adempimento di un obbligo di legge cui è soggetto il Titolare (art.6., paragrafo 1 lett. c. GDPR).
Le immagini sono cancellate decorsi i 7 giorni dall’evento calcistico cui si riferiscono, fatto salvo quanto necessario in relazione a specifiche esigenze di conservazione delle immagini per la tutela anche in sede giudiziaria dei diritti del Titolare ovvero qualora si debba ottemperare ad una specifica richiesta investigativa dell’autorità giudiziaria, o di polizia, o sportiva,
i) - Soft Spam - Inviarti comunicazioni commerciali via e-mail in merito a prodotti e servizi simili a quelli da te acquistati, salvo il tuo rifiuto espresso a ricevere tali comunicazioni, che potrai esprimere al momento dell'acquisto o successivamente.
La base giuridica per tali finalità è rappresentata dall’art. 130, comma 4 del D.Lgs. 196/2003 e dall’ interesse legittimo del Titolare (art. 6, par. 1, lettera f. GDPR).
I dati sono conservati finché non ti opporrai al loro utilizzo per tale finalità (opt out) ovvero fino a 24 mesi dall’ultimo acquisto.
l) - Marketing - Previa manifestazione del tuo consenso, effettuare attività di marketing, tra cui elaborazione di statistiche e/o ricerche di mercato, inviarti la nostra newsletter o altro materiale informativo e promozionale inerente alle attività, prodotti e servizi di Bologna F.C. e dei suoi partner, inviarti comunicazioni e sondaggi per migliorare il servizio (“Customer satisfaction”) oppure per raccogliere le tue opinioni. Tali comunicazioni potranno essere effettuate mediante sistemi automatici, e-mail, sms, posta cartacea e/o uso del telefono con operatore, notifiche web e push; il Titolare raccoglie un unico consenso per le finalità di marketing qui descritte, ai sensi del Provvedimento Generale del Garante per la Protezione dei Dati Personali “ Linee guida in materia di attività promozionale e contrasto allo spam ” del 4 luglio 2013. Nel caso in cui tu volessi opporti al trattamento per le finalità di marketing indicate e revocare il consenso prestato, potrai in qualunque momento farlo attraverso le funzioni disponibili sulla tecnologia utilizzata ovvero comunicandolo all'indirizzo mail indicato nella sezione relativa all’esercizio dei tuoi diritti. L’eventuale revoca non pregiudica la liceità del trattamento basata sul consenso prestato prima della revoca.
La base giuridica del trattamento è rappresentata dal tuo consenso (art. 6, par. 1, lettera f. GDPR).
I dati sono conservati fino alla revoca del consenso ovvero cancellati dopo 24 mesi dall’ultima interazione registrata.
m) – Invio di comunicazioni personalizzate basate sulla profilazione - Previa manifestazione del tuo consenso, analizzare i tuoi interessi, le abitudini, le scelte di consumo, le tue preferenze in relazione ai prodotti e servizi offerti, con l’ausilio di strumenti elettronici capaci di elaborare mediante aggregazione e raffronto i tuoi dati personali al fine di rendere più aderenti ai tuoi interessi e scelte le comunicazioni a te indirizzate relative a prodotti e servizi forniti dal Titolare. L’analisi di cui sopra prenderà in considerazione sia i tuoi comportamenti d’acquisto (data, oggetto e importo delle transazioni da te effettuate sul Sito o sull’App o presso i punti vendita sul territorio e on line, ivi compreso l’acquisto dei biglietti, abbonamenti e fidelity card), sia i tuoi comportamenti relativi alla consultazione delle comunicazioni commerciali inviate tramite e-mail, sia i comportamenti di navigazione, vale a dire le informazioni sulle modalità di utilizzo da parte tua dell’App e/o del sito in veste di utente registrato, ivi compresa la tua somiglianza nei comportamenti di consumo con altri utenti. Più precisamente, con i dati degli utenti verranno creati dei “cluster” (gruppi omogenei costituiti da profili che presentino un certo livello di correlazione) a seconda delle preferenze, dei comportamenti online dell’utente e degli acquisti effettuati anche attraverso i punti vendita fisici in modo da sviluppare comunicazioni digitali mirate, personalizzate ed in linea con i gusti degli utenti. Nel caso in cui tu volessi revocare il consenso per le finalità di invio di comunicazioni basate sulla profilazione, potrai in qualunque momento farlo attraverso le funzioni disponibili sulla tecnologia utilizzata ovvero comunicandolo all'indirizzo mail indicato nella sezione relativa all’esercizio dei tuoi diritti. L’eventuale revoca non pregiudica la liceità del trattamento basata sul consenso prestato prima della revoca.
La base giuridica del trattamento è rappresentata dal tuo consenso (art. 6, par. 1, lettera f. GDPR).
I dati sono conservati fino alla revoca del consenso ovvero cancellati dopo 12 mesi dall’ultima interazione registrata.
In relazione alle finalità di cui alle lettere l) e m), limitatamente ai dati raccolti tramite il sito internet www.bolognafcstore.com, Bologna FC e EPI s.r.l. agiscono in qualità di Contitolari dele trattamento ai sensi dell’articolo 26 del GDPR.
Informative di sintesi, integrative della presente, dedicate allo specifico servizio offerto o reso disponibile attraverso la app, il sito, ovvero applicazioni di terze parti, potranno essere rilasciate al momento del conferimento dei dati.
III. – Natura dei dati oggetto di trattamento.
L’invio facoltativo, esplicito e volontario di posta elettronica agli indirizzi indicati sui siti del Bologna FC comporta la successiva acquisizione dell’indirizzo del mittente, necessario per rispondere alle richieste, nonché degli eventuali altri dati personali inseriti nella missiva.
Saranno o potranno essere oggetto di trattamento, per le finalità indicate, le seguenti categorie di dati personali che ti riguardano.
a). – Dati personali comuni.
Nel caso di registrazione ai Siti ovvero della fruizione dei servizi disponibili: nome e cognome, data e luogo di nascita, codice fiscale, indirizzo di residenza, stato di famiglia, indirizzo di posta elettronica, username, password e numero telefonico, dati relativi alle preferenze d’acquisto, comportamenti on line, dati relativi ai biglietti acquistati, posto, fila settore ed evento.
Per la fruizione di particolari servizi potrebbe essere richiesto anche il tuo documento d’identità. Inoltre, può costituire oggetto di trattamento anche l’immagine che ti ritrae.
b) – Trattamenti tecnici.
Costituiscono altresì oggetto di trattamento il numero IP, uno o più identificativi del tuo dispositivo mobile, ed il tipo di browser da te utilizzato per la connessione (dati non direttamente identificativi), l’uso della APP anche per la ricezione di notifiche push, registrati automaticamente dai dispositivi logici di protezione e di controllo degli accessi (LOG FILES) e in caso di attivazione di specifici servizi. Tali dati personali saranno utilizzati, oltreché per garantire la disponibilità del servizio, anche al fine di controllo del traffico di rete. Si tratta di informazioni che non sono raccolte per essere associate a interessati identificati, ma che per loro stessa natura potrebbero, attraverso elaborazioni ed associazioni con dati detenuti da terzi, permettere di identificare gli utenti. Questi dati vengono utilizzati al fine di consentire l’eventuale autenticazione dell’utente e ricavare informazioni statistiche, anonime sull’uso dei Siti, dei servizi e della APP e di controllarne il corretto funzionamento e vengono cancellati immediatamente dopo l’elaborazione, salvo che la loro conservazione sia indispensabile per le ragioni sopra indicate. I sistemi informatici e le procedure software preposte al funzionamento della App (come ad esempio Apple Store e Google Play) acquisiscono, nel corso del loro normale esercizio, alcuni dati comunque riferibili all’utente la cui trasmissione è implicita nell’uso dei protocolli di comunicazione internet, degli smartphone e dei dispositivi utilizzati. L’Utente potrà consultare le informazioni sulla Privacy disponibili sui seguenti siti:

d) – Categorie particolari di dati personali.
Nel caso in cui Bologna FC effettui la raccolta di categorie particolari di dati personali, ex art. 9 Reg. UE 679/2016 (dati che rivelano l’origine razziale o etnica, le opinioni politiche, le convinzioni religiose o filosofiche, l’appartenenza sindacale, dati genetici, dati biometrici intesi a identificare in modo univoco una persona fisica, dati relativi alla salute o alla vita sessuale o all’orientamento sessuale), tu sarai preventivamente informato e messo in condizione di esprimere – nei modi di legge – il relativo consenso.
IV. – Natura del conferimento, fonti dei dati.
IV.1.- Il conferimento dei tuoi dati personali non è di regola obbligatorio ma, in alcuni casi, risulta indispensabile per consentirti di beneficiare di tutti i servizi disponibili.
Per le finalità di cui al punto II della presente informativa, il conferimento dei dati è necessario nei seguenti casi:
lettera a) Navigazione: il mancato conferimento può comportare l’impossibilità di navigare sui Siti e utilizzare la App;
lettera b) Registrazione: il mancato conferimento può comportare l’impossibilità di fruire dei servizi per cui la registrazione è richiesta;
lettere c) e d) Biglietti, Abbonamenti Accrediti e We Are One Card: il mancato conferimento può comportare l’impossibilità per il Bologna FC di emettere i titoli di accesso allo stadio e di rilasciare la We Are One Card;
lettera e) Codice di Condotta ed f) Servizi: il mancato conferimento può comportare l’impossibilità di erogare i servizi;
lettera h.1) Videosorveglianza: il conferimento è obbligatorio, il mancato conferimento impedisce l’accesso all'evento.
Per le finalità di cui punto II della presente informativa, il conferimento dei dati è facoltativo nei seguenti casi:
lettera h) Utilizzo Immagini: la mancata autorizzazione all'utilizzo delle immagini, non pregiudica il diritto di partecipare all’evento o comunque di beneficiare dei servizi;
lettera i) Soft Spam, l) Marketing, m) Profilazione ed n) Cessione a terzi: il mancato conferimento non implica alcuna conseguenza, salvo che non potrai ricevere le comunicazioni commerciali inerenti le offerte, gli sconti e le iniziative, se del caso anche personalizzati in base alle tue esigenze e preferenze, da parte del Bologna FC. e/o delle società terze.
IV.2. – Fonti dei Dati.
Raccoglieremo i tuoi dati, da te direttamente, attraverso le tue interazioni con i Siti e con la con la APP e in generale con i servizi di Bologna FC (quali ad esempio navigazione, iscrizione allo shop online, iscrizione alle newsletter, compilazione di form, iscrizione ai canali Web Push dei Siti, Acquisto biglietti, abbonamenti e fidelity card sia on line che presso i punti vendita), ovvero attraverso le informazioni ricevute da terze parti autorizzate, autorità, fonti pubbliche, terzi fornitori di servizi, se del caso nominati in qualità di responsabili esterni del trattamento.
V. – Modalità di trattamento dei tuoi dati personali.
In relazione a tutte le finalità sopra indicate, i tuoi dati personali saranno oggetto di trattamento informatico e cartaceo ed elaborati da apposite procedure informatiche anche al fine della personalizzazione dei servizi che Bologna FC è in grado di offrirti. Il trattamento dei dati avverrà in modo da garantirne la sicurezza logica e fisica e la riservatezza, e potrà essere effettuato attraverso strumenti manuali, informatici e telematici atti a memorizzare, trasmettere e condividere i dati stessi. Le logiche del trattamento saranno strettamente correlate alle finalità perseguite. Con particolare riguardo alla finalità di profilazione si rinvia a quanto dettagliatamente descritto al paragrafo II lettera m).
VI. – Destinatari dei dati e trasferimenti all’estero.
VI.1. – Responsabili e autorizzati al trattamento di dati.
Possono venire a conoscenza dei dati personali, di cui alla presente informativa, in qualità di Responsabili o Incaricati del trattamento: all’interno di Bologna FC, il personale qualificato, ciascuno limitatamente alle proprie competenze e mansioni e sulla base dei compiti assegnati e delle istruzioni impartite. All’esterno di Bologna FC soggetti terzi, anch’essi appositamente designati quali Responsabili o incaricati del trattamento – dei quali Bologna FC si avvale quali consulenti, anche in forma associata, società che offrono servizi informatici, società che offrono servizi di marketing e call center, altre società di servizio, nonché ad ulteriori soggetti in ottemperanza a eventuali obblighi di legge.
VI.2. – Trasferimento di dati personali all’estero.
I tuoi dati personali saranno conservati all’interno dell’Unione Europea. In caso di trasferimento anche tramite soggetti terzi, fornitori di servizi, le relative operazioni avverranno esclusivamente nell’ambito e nel rispetto del Reg. UE 679/2016 Art. 44 ss.
VI.3. – Diffusione (a soggetti esterni indeterminati) dei dati.
In nessun caso i dati personali potranno essere diffusi, salvo quanto
previsto al punto II, lettera h).
VII. – Diritti dell’interessato.
Gli articoli da 15 a 22, GDPR conferiscono agli interessati l’esercizio di specifici diritti. Il GDPR riconosce agli interessati il diritto di accedere ai propri dati personali e di ottenerne copia. Il diritto di ottenere copia dei dati non deve ledere i diritti e le libertà altrui. Con la domanda d’accesso, l’interessato ha diritto di ottenere da Bologna FC la conferma o meno se sia in corso un trattamento sui propri dati personali e di conoscere le finalità e le categorie di dati trattate, i soggetti terzi cui i dati sono comunicati e se i dati sono trasferiti in un paese extracomunitario con garanzie adeguate. L’interessato ha, altresì, diritto di conoscere il tempo di conservazione dei propri dati personali ed ha il diritto di chiedere la rettifica dei dati inesatti e la integrazione di quelli incompleti, la cancellazione (diritto all’oblio), la limitazione del trattamento, la revoca del consenso, la portabilità dei dati e il diritto di opporsi, in qualsiasi momento e senza dover fornire delle giustificazioni, al trattamento per finalità di marketing diretto. I diritti potranno essere esercitati mediante e-mail all’indirizzo di Bologna FC privacy@bolognafc.it, oppure mediante posta ordinaria presso la sede della società: Bologna Football Club 1909 S.p.A., Via Casteldebole 10 – 41132 – Bologna – (BO).
L’interessato che ritenga che il trattamento dei propri dati personali violi le disposizioni del GDPR o della normativa interna in materia di protezione dei dati personali ha diritto di proporre reclamo all’Autorità Garante per la Protezione dei Dati Personali con sede in Roma, Piazza Venezia, 11, ai sensi dell’art. 77 GDPR e/o di adire l’Autorità giudiziaria.

Il presente documento definisce le condizioni di utilizzo, da parte dell’ Utente, del Sito internet raggiungibile all’indirizzo web www.bolognafc. di proprietà di Bologna Football Club 1909 S.p.a. (BFC), con sede legale in Via Casteldebole 10, 40132, Bologna, P. Iva e Codice fiscale 02260700378, numero REA di Bologna 268824.
1. Utilizzo, responsabilità e divieti.
1.1 Utilizzando il Sito e/o anche semplicemente navigandovi, l’Utente accetta le presenti Condizioni di Utilizzo.
1.2 L’uso del Sito è limitato alla possibilità per l’Utente di visitare e visualizzare le pagine del Sito per uso personale; è inoltre consentito registrarsi al Sito, al fine di ottenere l’accesso ai servizi relativi all’acquisto dei Biglietti o Titoli di accesso disponibili sul Sito, ovvero per usufruire di eventuali ulteriori funzionalità o servizi.
1.3 È vietato qualsiasi uso del Sito per scopi estranei a quanto espressamente indicato nelle presenti Condizioni e/o pubblicato sul Sito stesso. A titolo meramente esemplificativo e non esaustivo è vietato:
(a) utilizzare il Sito o parti di esso per fini illegali;
(b) distribuire, trasmettere, modificare o manomettere in qualsiasi modalità il Sito ed i materiali in esso contenuti, per qualsiasi fine (ad esempio per fini pubblicitari, commerciali, di richiesta a terzi, anche se utenti del Sito);
(c) scaricare o trasmettere in via diretta o indiretta tramite il Sito: virus, macro, trojan, o ogni altro elemento progettato per interrompere o danneggiare o interferire con il normale funzionamento di un computer, oppure materiale diffamatorio, offensivo o di natura oscena o minacciosa o materiale che possa causare disagio, molestie o altre conseguenze negative;
(d) utilizzare il Sito in modo tale da: interromperne il funzionamento, danneggiare il Sito, deteriorarne il rendering o pregiudicarne l'operatività o la funzionalità, oppure violare o danneggiare i diritti di qualsivoglia persona, azienda o società (inclusi senza limitazione i diritti di proprietà intellettuale, di riservatezza o di privacy); più specificatamente è vietato qualsiasi uso e/o riproduzione, anche parziale, del Sito o dei suoi contenuti, o pubblicazioni sul Sito (ad esempio articoli, immagini, storie, software o altri materiali assoggettabili al diritto d'autore) che violino i diritti di proprietà industriale e/o il diritto d'autore di BFC e/o di terzi e/o altri diritti di terze parti (quali diritti di immagine o diritti relativi ai dati personali);
(e) creare o pubblicare un link ipertestuale a qualsiasi parte del Sito o accedere o cercare di accedere senza autorizzazione a qualsiasi parte o componente del Sito;
(f) usare e/o riprodurre, anche parzialmente, il Sito o i suoi contenuti, al fine di svolgere attività commerciali e/o vendite;
(g) utilizzare qualsiasi strumento automatico o manuale per monitorare o copiare il Sito o singole pagine del Sito o comunque parti del Sito e/o dei suoi contenuti;
(h) utilizzare mezzi automatizzati per inoltrare o effettuare ordini d'acquisto di biglietti.
1.4 La violazione delle presenti prescrizioni implica la responsabilità civile e penale dell’Utente e verrà perseguita legalmente. In caso di violazioni, BFC potrà altresì intraprendere ogni ulteriore azione di tutela quale, a titolo esemplificativo: precludere l’accesso dell’Utente al Sito, rimuovere contenuti non autorizzati, cancellare ordini di acquisto.
2 Registrazione al Sito.
2.1 La navigazione sul Sito è libera, tuttavia per usufruire di alcuni servizi è necessaria la registrazione e la creazione di un account personale.
2.2 La registrazione è consentita esclusivamente ad Utenti che abbiano raggiunto la maggiore età. Al momento della Registrazione, l’Utente deve fornire i propri dati personali ed accettare le condizioni di Utilizzo del Sito ovvero le Condizioni Generali nel caso di acquisto di Biglietti o Titoli di accesso. L’Utente risponde direttamente della veridicità dei dati inseriti, manlevando espressamente BFC da qualsivoglia responsabilità al riguardo. Nel caso in cui, per l’emissione dei Biglietti o Titoli di accesso, sia necessario inserire i dati di terze persone, l’Utente è direttamente responsabile dell’esattezza dei suddetti dati.
2.3 Per registrarsi al Sito l’ Utente dovrà:
(a) inserire i dati personali richiesti, scegliere una password sicura e completare il processo di registrazione secondo le procedure di sicurezza richieste.
2.4 La password di registrazione è personale e riservata e non deve essere comunicata a terzi. L'Utente è direttamente responsabile in caso di violazione delle regole sulla conservazione delle credenziali. È vietato creare sul Sito più account riferibili alla stessa persona e/o diverso soggetto giuridico (società e/o enti di qualsiasi tipo).
3. Registrazione mediante servizi di autenticazione di terze parti.
3.1 La registrazione mediante sistemi di autenticazione di terze parti implica l’eventualità di ricevere alcune informazioni personali sull’Utente dalla terza parte. In ogni caso la registrazione con tali modalità è soggetta ai medesimi requisiti della registrazione diretta.
4. Limitazione di responsabilità di BFC.
4.1 Le informazioni, il software e i servizi eventualmente disponibili attraverso il Sito possono contenere imprecisioni, nonostante l’adozione delle dovute cautele da parte di BFC. Quest’ultimo non rilascia alcuna dichiarazione o garanzia espressa o implicita per quanto riguarda il funzionamento del Sito e la sua affidabilità. BFC in nessun caso può essere ritenuto responsabile per qualsiasi danno, diretto o indiretto, speciale o conseguenziale, spese, perdite di profitto o qualsiasi altro danno subito dall’utente in relazione all’utilizzo del Sito. Il download e/o la condivisione di qualsiasi materiale avviene ad esclusivo rischio e responsabilità dell’Utente. BFC non è responsabile del contenuto di qualsiasi sito web al quale si possa accedere mediante link presente sul Sito. L’eventuale presenza di detti link sul Sito non comporta alcuna garanzia in merito all’affidabilità dei siti terzi. L’Utente risponde in via esclusiva del corretto e continuo funzionamento della connettività, dei dispositivi e delle modalità con le quali utilizza il Sito. BFC non sarà pertanto responsabile per alcun danno, di qualsiasi natura, derivante dall'utilizzo del Sito e/o dei suoi contenuti e/o dei servizi di vendita dei biglietti. L'Utente non avrà diritto ad alcun risarcimento nel caso di mancato utilizzo del Sito o di parti di esso in seguito a guasti, sospensioni o inaccessibilità del Sito o di parte di esso per qualsiasi motivo. È altresì esclusa qualsiasi responsabilità di BFC per gli atti, omissioni e condotte poste in essere da parte degli Utenti del Sito e/o di terze parti quali a titolo esemplificativo inserzionisti e/o sponsor e/o partner commerciali.
5. Modifiche e controllo del Sito.
5.1 BFC si riserva il diritto di modificare le presenti Condizioni di Utilizzo del Sito in qualsiasi momento, con efficacia immediata ovvero di modificare o rendere inaccessibile, o sospendere, il Sito (o parte di esso) anche senza comunicazione agli Utenti e/o monitorare eventuali attività e contenuti associati all’utilizzo del Sito, da parte dell’Utente, poste in essere in violazione delle Condizioni di Utilizzo del Sito.
6. Diritto d’autore e proprietà industriale.
6.1 Tutti i contenuti pubblicati sul Sito sono forniti da BFC ovvero da terze parti. L’Utente riconosce ed accetta che tutti i dati, le informazioni, le fotografie, i video, le immagini, gli audio, i software, la musica, le illustrazioni, le grafiche, le icone, le interfacce, le risorse logiche, le funzionalità, i testi e qualsiasi altro materiale presente su Sito sono di proprietà di BFC o di terze parti e sono tutelati dalla normativa nazionale ed internazionale sul diritto d’autore e della proprietà industriale. Il marchio Bologna Football Club (BFC 1909) è registrato ed è di proprietà del Bologna Football Club 1909 s.p.a. E’ escluso qualsiasi utilizzo del nome e/o marchio del BFC da parte dell’Utente. Non è in alcun modo consentito duplicare, copiare, scaricare, modificare o distribuire il Sito o i suoi contenuti, ivi inclusi tutti i diritti di proprietà industriale ed intellettuale (marchi, copyright, etc.).
6.2 Il download e la copia di materiale pubblicato sul Sito sono ammessi per uso esclusivamente personale. E’ espressamente escluso qualsiasi ulteriore utilizzo.
6.3 Ogni violazione sarà debitamente perseguita.
7. Obbligo di manleva dell’Utente.
7.1 L’Utente si impegna a tenere indenne e manlevare BFC da qualsiasi responsabilità, perdita, danno, pretesa, sanzione pecuniaria o di altra natura, costo e onere, ivi comprese, a titolo esemplificativo le spese legali, in relazione al mancato rispetto di quanto disposto dai presenti Condizioni di utilizzo del Sito.
8. Nessuna rinuncia e foro competente
8.1 La circostanza che BFC non eserciti un diritto o non faccia valere una previsione di cui alle presenti Condizioni di utilizzo del Sito non costituisce in alcun caso una rinuncia a tale diritto o disposizione. Qualsiasi controversia relativa all’Utilizzo del Sito è di competenza del Foro di Bologna.
9 Protezione dei dati personali nell’utilizzo del Sito.
9.1 I dati personali dell’Utente, raccolti ai fini dell’utilizzo del Sito e dei Servizi in esso disponibili, sono trattati nel rispetto del Reg. Ue 679/2016 (GDPR) in base alla Privacy Policy e alla Cookie Policy, consultabili sul Sito.
